Can parents be arrested for not registering their home schooled children every year in New mexico?
Reader question: What if they haven't done it since the first year of home schooling?
Is there anyway to not be arrested?

I can not find what the legal penalty is for not refiling in NM. I know that in GA it is a $50 fine. I really doubt that the parents would be arrest for failing to file.
ETA: Sorry Quid but you are wrong. Many states in the US have laws that require homeschoolers register with the state or local school district.
ETA: momo8…. The legal summary at HSLDA most certainly does say that reporting is required in NM. Perhaps you misunderstood the part about not reporting to the local districts. However it clearly states that homeschools must report yearly to the state superintendent.
From HSLDA:
1. Notify the state superintendent of their intent within thirty days of the establishment of the home school and by April 1 of each subsequent year. The April 1 notice must identify the school district. New Mexico home schoolers are under no legal obligation to notify their local school district that they are home schooling. Families who are receiving public assistance may need to notify their district in order to continue to receive public aid.

I’m not looking it up and I can still tell you no.
There are no laws in America saying you have to register your home schooled children.

Some states do have laws about parents having to notify the public school of their intent to homeschool their children, as Minnesota does. However, according to the Homeschool Legal Defense Association’s Summary of New Mexico Law, parents in New Mexico are under no legal obligation to register their children as homeschoolers. Therefore, your parents would not get arrested. You can look it up yourself on the website.
